Terms and Conditions
Last updated: 20 October 2026
1. About these Terms
These Terms and Conditions are an agreement between you and Yachtko("Yachtko", "we", "us" or "our"). They apply to your use of our website at https://yachtko.com and our software at https://app.yachtko.com (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you confirm that you are authorised to accept these Terms for that business. If you do not agree, do not use the Service.
2. The Service
Yachtko is yacht charter management software for businesses that rent out yachts. It helps you record bookings and yacht availability, track deposits, balances, refunds and VAT, manage your fleet, customers, payroll and expenses, create invoices, run reports, and give your team role-based access.
The Service is a back-office tool. It does not take bookings from the public, process your customers' payments, or act as a marketplace.
3. Accounts and team members
You must give accurate information when you create an account and keep it up to date. You are responsible for keeping your login details confidential and for all activity under your account.
The account owner is responsible for the people they invite. You decide which role each team member has, and you are responsible for their use of the Service under your account.
4. Free trial
New accounts can use the Service free for 7 days, with access to every feature. No payment card is needed to start a trial. When the trial ends, your account becomes read-only until you choose a paid plan. You keep access to view your data, but you cannot add or change it.
5. Plans, subscriptions and billing
Paid plans are priced by the number of active yachts in your account, as shown on our pricing page. Every plan includes every feature and unlimited team members. Prices are shown in US dollars and do not include taxes, which are added at checkout where applicable.
- Billing period. Subscriptions are billed monthly or yearly, in advance, and renew automatically at the end of each period until cancelled.
- Cancellation. You can cancel at any time. Cancellation stops future renewals and takes effect at the end of the period you have already paid for.
- Upgrades. Moving to a larger plan takes effect immediately. You are charged a prorated amount for the rest of the current period.
- Downgrades. Moving to a smaller plan takes effect at your next renewal, and only if your number of active yachts fits the smaller plan.
- Plan limits. You cannot add or reactivate yachts beyond your plan's limit without upgrading.
- Failed payments. If a renewal payment fails, your account may become read-only until payment succeeds.
- Price changes. We may change our prices. For existing subscriptions we will give at least 30 days' notice before a new price applies, except where a founding price applies.
- Founding price. Where we offer a founding price, it applies for as long as that subscription remains continuously active. It ends if the subscription is cancelled or lapses.
6. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Paddle is responsible for processing payments, issuing invoices for your subscription, and collecting and remitting applicable taxes. Your purchase is also subject to Paddle's buyer terms. Charges will appear on your statement under Paddle's name.
7. Refund Policy
If Yachtko is not right for you, you can request a full refund within 14 days of any payment, for any reason.
This applies to your first payment and to every renewal, on monthly and yearly plans. Every account also starts with a free 7-day trial, so you can try the Service before you pay anything.
How to request a refund
- Go to paddle.net and look up your order using the email address you paid with, then request a refund there.
- Or email us at info@yachtko.com with the email address you paid with and your order or transaction ID, and we will arrange it through Paddle.
How refunds are paid
Refunds are processed by Paddle, our Merchant of Record, to your original payment method. How long they take to appear depends on your bank or card provider.
What happens to your account
When a refund is processed, the paid plan for that period ends and your account becomes read-only. Your data is not deleted, and you can subscribe again at any time.
Cancelling is different from a refund
Cancelling stops future renewals. It does not refund a payment already made. For a payment made in the last 14 days, request a refund as described above.
Your legal rights
This policy is in addition to any refund or withdrawal rights you have under the consumer law of your country, and nothing here limits them. Paddle's own refund policy also applies to your purchase.
8. Acceptable use
You agree not to use the Service to:
- break any law or regulation, or help anyone else do so
- attempt to access accounts, data or systems you are not authorised to access
- upload malware or interfere with the security or operation of the Service
- copy, resell, sublicense or reverse engineer the Service
- store or process personal data without a lawful basis
- publish or disclose anyone's personal information without a lawful basis, including doxxing
- harass, threaten or send unsolicited bulk messages to anyone, including through the WhatsApp links in the Service
9. Your data and your customers' data
You own the data you enter into the Service, including your bookings, fleet, financial records and your customers' details. You give us permission to store and process that data only to provide the Service to you.
You are responsible for the accuracy and legality of that data. Where you enter your customers' personal data, you are responsible for having a lawful basis to collect it and to contact them. How we handle personal data is described in our Privacy Policy.
10. Invoices and tax
Invoices you create in the Service are documents you issue to your own customers. You are responsible for their content and for your own tax obligations. Yachtko is not an accredited e-invoicing provider and does not submit e-invoices to any tax authority on your behalf.
11. Availability and changes to the Service
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free access. We may suspend access briefly for maintenance, security or operational reasons, and will give notice in the Service where we can. We may add, change or remove features over time.
12. Intellectual property
The Service, including its software, design, branding and content, belongs to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription or trial. They do not transfer any intellectual property to you.
If you send us suggestions or feedback, we may use them to improve the Service without any obligation to you.
13. Suspension and termination
We may suspend or terminate your access to the Service if:
- you materially breach these Terms
- you repeatedly or seriously violate our acceptable use rules
- payment for your subscription is not made
- we are required to do so by law
You can stop using the Service and close your account at any time. What happens to your data after your account closes is described in our Privacy Policy.
14. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties of uninterrupted availability, fitness for a particular purpose or non-infringement. Reports and figures in the Service are based on the data you enter, and you remain responsible for your own business, accounting and tax decisions.
15. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or business opportunity. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
16. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will tell you by email or in the Service before it takes effect. Continuing to use the Service after the change means you accept the updated Terms.
17. Contact
Questions about these Terms can be sent to info@yachtko.com, or through our Contact page.
